Recently I bought a new mobo, cpu, gpu and RAM, a new pc:

mobo: z170
cpu: intel i-7-6700k
gpu: Asus geforce gtx 1070
16gb RAM

After getting everything installed with my old hdd I tried to start a game which Ive been running on 60 fps before the upgrade with these specs:

mobo: MSI p67a-c45
intel - i5 2500k
Nvidea geforce gtx 560 Ti
8gb RAM

Using the same psu for both which is an antec that can output 550w.

Basically with the upgrade it kept being 60 fps, it ticked over a couple of times which means its not capped at least. I would like to know why it's doing this and what I can do to fix it if possible. I feel like with the new specs I should be able to have more fps with the same graphics settings on a game like "SMITE".

Have you uninstalled the drivers for the 560 Ti and installed the latest drivers for the 1070? Is the motherboard bios up to date? You may have to reinstall Windows...the old HDD has the drivers for the old chipset and gfx card. You're lucky, my PC froze at the desktop, last time I did that. Had to install everything from scratch to get past it.

That was the first thing I checked, even when its turned off there's no diffrence.

Update: Tried to launch fallout 4 which ive been playing on the other specs before, it wouldnt even start...could it be related to something Ive done wrong when I built it?
