Question nvlddmkm stopped responding

I usually spend time looking online for solutions but this time I'm really stuck with this issue.

X570S AORUS ELITE AX
AMD Ryzen 7 5800X3D
ASUS TUF RTX3070 GAMING OC V2
CORSAIR RM850x GOLD

-Updated all my Bios, Chipset, C++, DirectX, Graphics Driver (as well as tested with older ver. using DDU)
-Reinstalled Windows with no other programs, just tested with my game and game crashes always around 10-20 seconds after passing menu, where actual demand for 3D rendering happens.
-Tested with 3Dmark, software crashes at random intervals
-No blue Screen / shutdown so far
-No LED blinking on GPU to indicate power lacking
-Tested with another GPU (EVGA RTX2070 Super) and everything works ok

-Did Windows Memory Diagnostic and found no issue
-Tested XMP enable / disable
-Tested Graphics settings (enable / disable High performance)
-Tested MSI Afterburner, noticed that the GPU clockspeed sometimes exceed the boosted clock (But I did not set to overclock, instead tried to underclock in testing) Noticed that graph sometimes shows GPU usage spikes when the crash of application happens.

Did you clear the CMOS after you'd verified that the BIOS was successfully flashed to the latest version?

Reinstalled Windows
Where did you source the installer for your OS?

Tested with another GPU (EVGA RTX2070 Super) and everything works ok
Did you drop the assumed culprit RTX 3070 onto another system to see if the issue persists on the new system?

Yes I have did a CMOS reset at some point after I flashed BIOS ( this build uses all new parts and I flashed the BIOS before I start the build)

Where did you source the installer for your OS?
I have a thumbdrive which I prepared with a Windows install media too on Microsoft website.

Did you drop the assumed culprit RTX 3070 onto another system to see if the issue persists on the new system?
I would get to that and update here.

How old is the PSU in your build?

This is a brand new build with all new parts
