Specs:
CPU: AMD Fx 8350
GPU: GTX 1050 TI
Ram: 16GB DDR3
Motherboard: Asrock 970 M Pro3

I bought this PC from amazon 2 months ago i started trying out playing some games for example resident evil 2 where my fps was at 20 fps on medium settings when its supposed to be at least 60 fps so i started researching and did some benchmarks and saw the my CPU was really under performing.

So does anyone know why my PC is under performing?

probably vrms overheating and the cpu is thermally throttling. What cooler are you using? Guess it's the amd cooler. What resolution, gfx settings, 1050 isn't the most powerful gtx anyway and what psu make model and wattage ? What speed is the memory, not that it makes a huge difference on fx gaming.

Do you monitor temps with hwinfo64? Also the board is not one really recommended for an 8350. Two things you might be able to try immediately to see if it stabilizes temps. 1)add a fan to huff directly on the rather dinky vrm heat sink 2)simply switch off 2 or 4 cores in the bios. Counter intuitive but the game probably only uses 2 threads but it will reduce the cpu power consumption and temps.

This is also weird

16GB DIMM DDR3 800 MHz clocked @ 400 MHz

Never seen that before, memory running at half speed for some reason, what's the make and model of dimms, what's it set to in the bios is it on the qvl for the board, might be by chance that you selected a brand of memory that happens to be less compatible with your board.

You can also run memtest86 to check it for errors. It needs to be on a bootable usb. Basically a bunch of problems, weak 4+1 power phase on the vrms, sounds like it's all mismatched hardware.

well ill try but if i cant return it is there any other reason for why the pc is under performing other than the parts being mismatched and is there a way i can fix that?

They mega rip you off complain to every consumer organization if they give you any shirt. Don't defend it, it's a blatant rip off. You obviously know nothing about pc's the fx is obsolete dead and the pc isn't working even according to it's specification and the price is enough to build ryzen pc x 3. It's like getting a ford escort for the price of a mercedes.

i tried but they said since i live very far away from america and that its been 2 months its impossible for me to return it now so no all i can do is deal with my PC and try to fix it.

You should have done some research. You were ripped off. Any AM3+ motherboard with the 760G chipset is the absolute bottom of the barrel. You need a good 990FX board to run a FX 8 core cpu.

Incorrect, the board is a 970 Board which SHOULD run an 8350. However plenty of manufacturers made 970 boards with junk 4+1 VRMs, this being one of them. I agree 8 core FX chips have no business on a 760G, but also no business on a 970 with 4+1.

I don't see any way this system won't have problems without putting a cooling fan blowing direct on the VRMs. Then maybe it will work right.
