They used a readymade data set. Yes they are randomised in the sense what became a stop or gym but the location data was not random generated but croudsourced. And since it was a dataset that was collected they could have if they wanted to remove places before the launch that have now caused issues like harbors, military bases and auswich.

sooo according to this... anytime i view a hateful comment repeatedly on a pc on my property. I have the right to sue for invasion of ones use for enjoyment of my property. ..... I don't even like the game and it's common since that Niantic shouldn't be dragged through a legal suite because some people are generally ticked off on a daily basis and can't stand someone walking along down the streeet and asking them to use their property for a moment.... because of walk in hunting the property my family owns gets pestered more often by hunters wanting to shoot guns on our property because of WALK IN HUNTING POKESTOPS placed all over with no discretion. I cant wait for all the lawsuits that come available if a precedent is setttttt!!!!!! MONEY TRAIN FOR THE PEOPLEEE

I do not understand this. People hear "pokemon" and automatically think they can make easy money by sueing. When Ingress came out and uses the same map data with portals no one cared, no one sued, hell most people didn't even care or knew about the game. But as soon as they hear "pokemon" and think it is related to Nintendo they get sue happy.

What are they going to do when they find out that Pokémon Go have little to nothing to do with Nintendo?

No one is getting "sue happy" cause it's Pokémon. People are suing because players are intruding on private property, places that have no business having pixels to capture. Not sure how that is hard to understand. You want your doorbell constantly ringing by people non stop wanting to come into your yard?

So by your logic I should sue God because Jehovah Witness keeps knocking on my door every Saturday when im trying to sleep!

Its why we don't drink and drive, or drive under the influence because we know if we drink then we accept responsibility of what happens when we get behind the wheel. Same here, if we play the game and decide to enter private property at the middle of the night then we must accept the responsibility when we get shot!

That's actually not a great analogy, as in some places there exist laws stating that bars have a duty of care towards their patrons. They have a responsibility to help an intoxicated customer get home safely (e.g. calling them a cab), and if the person does drive home the establishment can be liable if someone (the customer or 3rd party) gets injured.
Not saying I agree with the suit, just pointing out that your analogy might make the opposite point that you intended.

Maybe we are not from the same country but I think the message comes across perfectly because last I checked an individual does not have to go to a bar to have a drink in the US . Liquor is everywhere and anyone can get drunk at any time without stepping foot into a bar. If I step into a supermarket and pick up 3 bottle of wine and a few 6 packs and decide to drink them all in the parking lot then drive, the employee is not going to come out there and call me a cab. Same if I step into a liquor store like the many we have in NYC on almost every street corner and get a $20 bottle of Grey Goose, drink it all in one gulp and decide to drive home.
