Probably the WORST 4770k ever

hi everyone
so i would like to tell you the story about the worst 4770k ever created.
about 6 months ago i bought the following gear:
Cpu: 4770k (directly from intel with a worker discount as my sister works at intel)
ssd: intel 530 series 240gb (from intel as a combo cpu+ssd)
mobo: gigabyte z87 d3hp
psu: corsair vs550
gpu: asus GTX 760 DirectCU 2
memory: G.Skill Ripjaws-X F3-1866C9D-16GXM
and used some parts from my old pc
HDD: samsung 500gb + WD 150gb
case: thermaltake soprano rs
heatsink: arctic freezer 7 pro

as i first launched the pc (everything on stock settings in BIOS only turned temp warnings on and disabled intel onboard gpu)
i did a prime95 small FFTs test using realtemp
and as soon as i hit the start button i got a temp warning (90*+ ).
well i thought it must be because i didnt properly installed the heatsink or didnt apply the thermal paste correctly.
after trying re installing the heatsink a few times and even using the (arctic mx-4) paste,
every time i launched prime ffts i got temp warning.
so i went and bought a new heatsink,
the enormous Scythe Mugen 4
hooked it up and run p95 again only this time it takes about 30 secs until it starts going over 90*
let me remind you EVERYTHING is on default no oc, no Xmp, nothing
by default settings the cpu at max load runs at ~3.7 ghz on 1.25 V

after trying manually reducing the vcore without changing clocks or uncore i got it to boot up at 1.2V but i cant do a stress test because temps after a few seconds reach 93*+ and i stop the test
after spending a lot of hours this week tweaking and testing i came to a conclusion that i got the worst 4770k in the whole world
i threw the box that the cpu came in so i dont have any serial numbers, Packaging or labeling info
but on the top of the cpu there is writing that says "Costa rica"
is there a way to find my batch and serials without the box?
can my chip be really that bad or am i missing something?
is there a way to try replacing it under warranty or even add a few bucks and get the 4790k as (i mentioned above the cpu was bought straight from intel in a cpu+ssd combo ) and i dont really know with who should i talk about replacing/upgrading it
if you got any other suggestions i would like to hear them.

on the current setup with the Mugen
the intel dignostic tool gives me a pass and and reached maximum temp of ~70*c
so does their test is not stressing the CPU enough?
or maybe i am using p95 wrong?
should i contact them with the current setup or should i put the original heatsink and remove the gpu so their diagnostic tool will have a chance to fail the test?
 
i looked at the pictures you have pretty beefy heatsinks. i'm slightly stumped but i can only arrive at 2 conclusions. you installing the heatsink wrong OR you have a bad processor. and intel diagnostic tool doesn't stress the cpu like prime95. prime95 is running fine it's supposed to get hot but not that hot at stock temps. double check you are installing the heatsink correctly make sure all washer and fitttings and stuff are there, use a rice grain size amount of thermal paste and let the heatsink pressure form installing it spread it out naturally. if that doesn't work, save the headache and try sending it back and getting another processor. maybe you got unlucky.
