Well, I've been rocking my new rig for about a week, but hadn't stress tested it yet as I haven't done anything really demanding with it just setting up software and tinkering with media center settings and scripts... until today. In preparation for playing Skyrim ay ultra with lots of graphical mods I thought I'd test it and see what it could handle to get it OCed.

850w psu (I forget the make/model but its 80 plus bronze.... freebie from my brother in law)
Antec New Solution VSK-2450 (another freebie)
corsair H60 <<my likely problem
I have been idling about 35-40 which hasn't really concerned me but
running p95 i saw temps hitting 100 in about a mins time (stock clock)
and with linX i saw 105 almost instantly, i let it sit for just a moment to make sure it wasn't a glitch but it was no good
I had my radiator fan and front fan both as intakes, and thought that may be the problem, but the case still has plenty of ventilation for exhaust. And even after flipping the radiator fan i see no difference. Could it just be thermal paste (factory paste currently)? should i bother to change it or send that thing back to newegg?
i originally planned on using the H60 because i was using a much smaller case, but I stumbled upon a decent antec case so that's not a problem now...
So should I replace it or get my money back and get an air cooler? and if so, any suggestions? quiet, great cooling (i really want to OC) and cheaper than $65 US, oh and preferably not the size of a cinder block
