Actually I have tried to plug it in with and without the harddrive a 2.5 toshiba from a laptop. I still get an issue with failure to install driver. When you have the usb cable plugged in and you take the harddrive off and put it back it prompts again for installation of driver and still fails.

I don't think its DOA though?? Because you can hear the hardrive whirling and feel and tell its being powered up. Technically I don't think its failing to read the drive, as I said it does this without it plugged in. It is simply failing to install the drivers.

I have windows 7 on a hp laptop for what it is worth.

Is there some way to fix the driver issue?
 
Rather than describe the problem as a "failure to install driver", precisely how is your SATA-to-USB failing to carry out the task you've given it?

When you connect the device to a drive and connect it to the laptop's USB port, what happens? The drive is not detected by the system? How is the device malfunctioning? What exactly is the problem?

 
You might try to check the power requirements of the DD from the laptop that you are trying to use. That adapter cable has no way to connect power from an independent source. its only power available for both adapter and HDD is that from the USB3 port. And it MUST be a USB3 port! A USB3 port can supply up to 0.9 amps at 5 VDC (4.5 Watts) to a connected device. So your HDD MUST require no more than that. And you can NOT get that much power from a USB2 port - they are limited to only 0.5 amps.
