Ok so I have a string of posts here about my R9 290x - been uber problematic. I had to get a new PSU and everything and its STILL restarting.

COuld this be a windows 8 thing?
I run

Corsair 750w
8gb Crucial Ballistix RAM
Asus XML USB 3 Mobo
R9 290x
Windows 8

I think I shoudl downgrade - should I downgrade?

How is the heat issue with your card and system in general? And I'd submit for an RMA right way while you look for other possibilities. You have a limited time you can return as DOA.
No that's fine, the issue is probably a defective GPU, that is incredibly common with the R9 line, especially the 280X,290, and 290X. See if you can RMA your card, that may solve the issue with a new one.

The heat is 40*c I use a dynamic Fan Overclock to clock the settings when needed - Specific Temps = Specific Fan speed.

40c seems pretty low for that card, perhaps I missed it what power supply are you using?
