Evil or not, what they did was FRAUD and a violation of their contracts with both Intel and the OP. You may not care if you are anyone else gets screwed (ignorance is bliss), but the rest of us actually do. We are eager to see the results and find out who the retailer is so that we can recommend against others making the same mistakes.

As for wasting time, as another poster mentioned, it is possible to get his money back AND get the processor from Intel (may not be ethical, but possible). Free high-end processor, big waste of time huh?

Yes .. I have plenty of time here. I'm in no rush at all. The fact of the matter is .. I paid $$$ for what I thought I was receiving and that was a OEM version of the Core 2 Extreme X6800 .. what I received was a well USED Engineering Sample that by Intel's Policies and Procedures was NOT to be sold to consumers. And the most stupid thing is .. they did this twice !!

So .. in light of me receving the wrong products in the first place .. me reporting it to Intel .. sending them everything I have in regards to the Retailer from Invoices, Receipts, emails, pics of the first CPU .. and now sending them Invoice and a physical CPU .. you tell me. If Intel rewards me nicely for what I have done .. then ALL this would definately be worth the hassles I have gone through. If Intel even sent me a retail boxed version of the Core 2 Extreme X6800 .. it would still be a reward to me.

Now .. this is what I am meaning by the above statement. What the Retailer does not know is that charge account I used to purchase the product with in the first place .. I work for that financial institution :lol:

Do you think this is all worth it now ?
 
Well,

I doubt they would send you anything but what you originally ordered. And if they do end up doing that, I don't think the hassel was worth it. Simply because the amount of money you would have spent on shipping and driving and all the waiting you will have ended up doing. If they were to send you a quad, then sure, it was worth it. I don't have any clue as to why they would send you a more expensive CPU than what you ordered though.

We'll see shortly. The fact that corrupt retailers is out there is what pisses me the most .. especially if you pay that amount of monies for something .. you expect a little better than trash.

Shipping .. no problem .. if the outcome of all this with Intel and retailer comes to something .. worth every penny I spend to get this trash retailer off the market line. And believe me .. I'm not the only person who has filed a complaint against this retailer .. there is a LONG list.

Monies spent to me basically no problem since .. if you read what I wrote before .. you'll find that the charge account I used to purchase this .. is the same place I work .. only takes 1 call to get my monies back and have a investgation thrown against the retailer from the financial institution .. so believe me when I say .. I'm not wasting my time.
 
The thing that gets me is this. People that don't know about this could easily be taken for a ride. I hate people who prey upon those with no knowledge of whats happening to them.

Amen. You might even say (if you are a caring person) that its your duty to do this when this happens to you. There is a reason why people come to "us" asking our advice for what to do. Its because we have shown through our actions in the past that we have a small idea of whats going on with computers and know what should and shouldn't be done. If someone had pulled this on me or someone I was working for, you can bet that I'd be doing the same thing. I'd be doing the same thing if I bought retail and they shipped OEM.
 
Looks like the etailer tried to screw over the wrong guy. Gotta say, its really nice to see this. Aside from Hero's this is the best entertainment to date!
 
I did something similar when I tried to get a refund from Blizzard for a month a WoW use. You get a free month, you register your email address, yet you are not told when your free time expires, nor are you informed when you will be billed.

So I contacted them, asked for a refund of the month, because I didn’t like the game and I barely played it. They decided that they would not refund the money because I had called just 3 days after the 30 day trial expires. Since I bought the game, I decided to sell it. NAY! Apparently Blizzard decided that they owned the game and the normal laws that allow you sell anything you own aka, phonograph (that is, the content on the disc). I forwarded them the link and explained that they cannot restrict me from selling or transferring the key/game on eBay. Later they responded saying that the note was passed to Blizzard's president and I will be contacted shortly.

Upon reading the response they agreed that if I sold my copy of WoW on eBay they would provide the recipient of my copy a fresh key that the person who bought my copy can use.

What about my refund? After 3 months of back-and-forth emailing they finally agreed to refund the whopping 14.95 charged to my visa. Now, that was fine, but I wanted them to pay for the interest I would have been charged had I left that amount on my Visa and allowed the interest to accrue. NO! They refused and simply stated that my refund was being "processed". This "processing" took 5 months! I was furious with them, how the #$% does it take 5 months to chargeback 14.95??!?!?! This whole thing started in December and ended...in JUNE!

I will never pay a monthly fee to Blizzard EVER! Their EULA is absolutely disgusting and completely violates the phonograph laws that allow us to own and sell the property we purchase. Basically, if you bought a car from Blizzard, and later decided to sell it, Blizzard would force you to impound the car, hand the keys over to them, and then they would in turn, sell it to someone else; all the while you are out of the entire amount of money you spent on purchasing the car. Now you can see why this is such a farce! Seriously, what is the problem with selling a game of WoW through eBay? I just can't comprehend what they were thinking when they concocted this absurd restriction, it is after all, a subscription based game!

Yes, 'evil' - if you view through the eyes of Intel. If the retailer sold it to some random person, what would stop them from selling it to say, AMD? Via?

About as much as what stopped them from selling it to a random person, if the retailer was even aware that they had an ES. We don't know if their supplier was from China and stuck the ES in to cover their asses.

I never said the recipient was evil, just the deed. It goes to show whoever sold the retailer was unscrupulous, not evil.
 
Great thread LordGeek. You have been very professional throughout this whole ordeal. Kudos goes out to you and the great people on the TG Forumz. I think its hilarious how dumb that etailer is. Not 1 but 2 ES chips get sent out. This is even after you busted their chops with a letter....rofl.

Eric54 no offense, but you're story is way different from lordgeeks. It's all over the place that after 30days the trial is over. You're lucky that you got your 14.95 back. This goes to show, even though it took them 5 months, Blizzard is a decent company. And I see in no way how Blizzard pulled an illegal stunt like the etailer with the 2 ES samples did.
 
I would say that to call them unscrupulous is being way too kind. They sold him a OEM 6800 and sent him an ES (of a different chip). Then when it was brought to their attention they defended it. Then they sent him back another ES, the fact that it was a different one means they had many onhand that they were selling fraudulently.
 
It may have been an ES of the 6800 seires but as has already been stated, engineering samples are not to be sold/resold. Most engineering samples are shipped free to the recipient for testing and validation of chip/circuits that are being made to work with a new chip design. While an ES may be "gifted" to an employee after it's no longer of use they are not supposed to be sold to the public.

In this case it looks like someone acquired a tray full of some of Intels most expensive cash cows and decided that most of the public wouldn't notice what they got or wouldn't notify Intel of this breach and misuse of samples.

I doubt it cost Intel more to make an X6800 than it does to make an E6300 but someone else is milking Intels cash cow.

I think this is really the crux of the problem here...

For every ES X6800 that is sold, that's ~$900 that Intel's losing out on. Moreover, it gives Intel a bad name when the X6800 craps-out or doesn't perform as expected. If this company has many on stock and is selling ES' as OEM's, then they're costing Intel thousands of dollars.

It behooves them to reward the whistle-blower. Let's hope the award is a nice QX6700 😉 I'm sure it costs Intel pennies on the dollar compared to retail.

@op: and to be frank, I have no idea why you can't tell us who the e-tailer is. You have a special contract that once you buy some goods from them you can't talk about it? cause it would be free advertisement to them and that is a bad thing? (assuming you were happy with the goods)

Pls tell us who is this e-tailers. Whether you tell us or not, at this point it makes absolutely no difference for your case. :?: :?: :?:

It doesn't matter what the name of the retailer is for now. Once the matter has been resolved, LordGeek will name and shame the retailer as he has already said.

Simply because he doesn't tell you doesn't mean he doesn't have a good reason. He said he would eventually, so be patient. It wouldn't surprise me if Intel told him NOT to tell people.

Sometimes I think there out to be a minimum age requirement here...

Then I remember there are some kids who actually post something useful.

Well there's the exception and then there's the rule. We can usually bully the idiots out of the forum, but it seems this bunch has formed a small clique.
 
Well heres a little heads up for all you followers .. my wife just called me, said a package arrived from Intel (because good ole me is a work) .. I had her open the box .. inside is a brand spanking new ************

Guess what ..
