Yes, it will fit. There is a chance that you will need to remove the HDD-Bay to make space.

From the Fractal Design website for your model case:

Supports graphic card lengths up to 270mm when removable HDD-Bay is in place
Supports graphic card lengths up to 420mm without removable HDD-Bay

I dont have the top bay in anyway, just 1 bay

Not really a concern, shouldn't be an issue. CPU heatsinks are designed to not interfere with GPUs (this is all part of the ATX standard to have standard distances between system components).

What make/model heatsink are you using?

Its the H7 Cryorig, as you can see the end of the CPU cooler sort of slopes down, which means it is nearly touching the GPU..

Ok, so its not a problem that it is sloping down and near enough touching the top of the GPU? because i was wondering i have the R9 270x now and if I get the 970 it'll be bigger right so it will touch the top of the CPU cooler?
