I was wondering if my motherboard will be able to use this CPU. I'll be giving my full build own below in case it is needed.

As long as the motherboard BIOS is up to date then yes it will work with the 9600K.

So if i were to update the bios, while having the cpu installed into the motherboard, will it then work?

If the BIOS isn't up to date and you try to boot with the 9600K then it won't work. Or just change out the motherboard for a Z390.

Recommend to buy the z390 for the i5 9600K, like asrock z390 Extreme4. https://graphicscardhub.com/best-z390-motherboard/

The reason is the BIOS, just like other member said. According to asrock the MB (z370) will need 3.20 version BIOS to support the 9600K, and nobody will know it has or not until you open the MB box.
