Win 7 Upgrade to new SSD

My dad has a issue i'm not to sure about. He currently has Windows 7 Ultimate on his computer and would like to install a SSD as his new bootable disk. Now the problem is the copy of his Win7 Ultimate is an Upgrade copy from Vista, and he no longer has the Vista OS retail disk. Could he just pop in the Win7 Upgrade disk into the drive and boot with that and his upgrade product key? or would he have to install Vista first, activate it, then use the Upgrade feature in Windows to get his Win 7 back?
