its legit but you still have to do the upgrade first so it validates your windows cd key for windows 10

No, you can manually apply the upgrade if you run the setup and select "upgrade this pc".

It will be activated if you use this method. There may be a delay in showing the activation as there are other people pinging to microsoft servers.

Yes, what you download is just installation media so you can upgrade a PC or do a clean install, it's all the same basically.
When you put the disc in it will give you the choice of doing an upgrade or a clean install.

Yes, a blank DVD to burn a Windows DVD, or a 4gb or larger USB flash drive.
