I bought a Verto Graphics card from PNY Technologies about 15 months
ago. The warranty on the side of the box of this G Force FX5200 128
Meg stated that the card had a "Lifetime Warranty" The fan went bad
this week and I contacted them on their web site for an RMA to send
the card back to them for a repair or replacement.

I got a response yesterday that the card was out of warranty. I
returned the message stating that the box clearly states that a
Lifetime warranty was valid on this product. I get another email
today, and here it is

So what he is saying is that the model of card that I bought is not
sold anymore, superceded by a new model, so the warranty is worthless.
Last PNY card I.

Otherwards your scr'd. You can try to locate them and write the Better
Buisness Bureau etc. But you're probably out of luck. Online or in
person stay with big name out fits. Most will honor the original
warranty or cut a discount on a new card.

Bob,
Does not this last part mean that they will replace the whole card free of
charge with a new one? Ask a lawyer..

ISTM that PNY is a second-tier seller in the "value" segment. Better go
with someone a little higher up the food chain. ASUS and Chaintech
version of that card are available at around $45.

Yo Bob,

That card is being sold all over the net including Amazon, do a google
search and then send the links to PNY. This way they'll have to honor the
warranty.

If they do not manufacture the exact same card any more, it will not
help that it is still sold from resellers stocks.

As they state that "Lifetime Replacement warranty does not cover items
out of production if PNY no longer stocks them" they are the ones who
are covered by their terms.

Need to read the fine print, lifetime warranty sounds just too
good...:-(

I guess that would be like buying a 2005 car with a 5 year power train
warranty that is only good until the 2006's come out. 😉

No, what it means in plain English is that the warranty was only valid
while the product was being manufactured. Once it stopped production, all
warranties ceased! ;(

I'm not a lawyer, but this definition --

"Lifetime is defined as the lifetime of the product on the market.
Outdated technology is not covered by lifetime warranty if the item is
no longer available on the common market as a new product.)"

-- seems to be saying that a product "dies" when you can't buy it new
from normal sources. I.e., what defines a dead product is NOT whether
it's still being manufactured, but whether you can purchase it new
through retail channels. If you can, the product is not dead and the
warranty still applies.

Just did some rereading. It sounds to me like there are really two
definitions of "lifetime" in this warranty: (1) we still make it and
(2) you can still buy it. Sounds like they're using (1) to minimize
their obligations.

I don't know, maybe that's good law. Let's just hope it's not the way
any of us run a business. Thanks for the warning, Capt. Bob.

Here is a copy of a portion of an email I received today from PNY
regarding my email to them about the fact that the cards are still on
sale on the web.

While I agree that's a shi**y way for a manufacturer to act, why not
goto fry's a pickup a new fan? Most of the fans are standard sizes and
fry's or other computer part stores will most likely stock them for
around $5.

You can try CompUSA if you have them close to where you live.
They carry a pretty good selection of fans, or at least the one by me does.

I believe Fry's is largely a California phenomonon, although they also
have a dozen or so stores in Texas.

Nothing here in Winchester UK. I walked all around the city, definitely no
Fry's apart from our local fish and chip shop. There the fries are free to
pensioners at lunchtime yummy!
