So, an update on the situation.
On the 20th of February, I waited in line at Microcenter for a 5070ti because I was not about to allow a scalper to screw me over or allow me to go yet another year with an almost decade-old graphics card (upgrading from an i7 6700K and GTX 1070)
I got the card for $909.00 USD, which irritated me because the card is $750.00 MSRP. That would be the beginning of the new computer build. I later noticed on the 17th of March that they decreased the price of the same model 5070ti to $850.00, so I returned to the store and got a $60 gift card for later use.
I opened the card on the night of March 19th because I knew the return policy only allowed for 30 days, (or so I thought), and found out that the 5070ti I had received was defective in that it has less ROPs than what was advertised.
The next morning, I reached out to you all on the Toms forum once I got to work to try and figure out my next course of action. I hated the idea of waiting for a month to get a new card from MSI, but also didn't want to run the risk of returning the card, only to be stuck again where I was before as if I never waited in line at the micro center at 2 am on the 20th of February. I had too much invested in this whole thing.
So, I reached out to MSI, they confirmed it would be anywhere between a 2-3 weeks to get a new card to me ONCE they received my current card. so roughly a month of waiting.
I then reached out to the Microcenter service phone line and explained the situation. I told them I understood that these cards were in high demand but that if there was anything they could do for me I would appreciate it.
The Woman on the line was very kind and helpful, she told me that she would have the manager of the store reach out to me to try and figure out what to do. She also informed me that for CPUs the return policy is 15 days, and for items where you still have the box and all cables. they can accept returns for up to 60 days.
He called me before their store closed in the evening and already understood my situation, he told me that if they got another card in, they would hold it for me. He assigned the same salesman who helped me with checking out on the 20th of February to assist me with the process.
On the side, I had also been trying to get my hands on this AMD 9800X3D CPU/motherboard/ RAM combo that Micro Center had been offering, but the motherboard was never in stock each time I would come in for the past 2 weeks. I asked the manager if they had any shipments coming in with the motherboard, he told me they had a big shipment coming in the next morning, but was not able to tell me what was on it and did not have immediate access to the information. We hung up and I went to sleep for the night.
I woke up at 9:26 am the next morning to a phone call from the Micro Center helpline. I was asleep when they called, but the call woke me up and I tried to answer it but I was a half second too slow and wasn't able to answer it in time. frustrated, I tried to call back, but it was an automated message saying that they weren't open yet. The store opens at 10 am.
I sat in bed frustrated for about 5 minutes until I realized that if they were calling me, it must have been for some sort of purpose- and that even if they didn't get a new 5070ti to help me with my exchange, I could at least go to see if they had the MSI Tomahawk motherboard I needed to get my CPU combo. I got up, booked it to Micro Center, and got there at 10:10 am.
I walked into the PC section with my defective 5070ti, explained the situation, and told them that I had a defective unit with fewer ROPs and that I had spoken with their retail manager the night before. I asked if they had any 5070ti's in on the shipment, and they confirmed they had one, and only one, and it was my exact model as well. they said they were holding onto it for me and it was the only 5070ti that they had.
I asked if they received any of the tomahawk boards and they, in fact, did from the shipment, So I got my CPU bundle as well.
I completed the exchange, got all the parts I needed, and am ready to build my new rig tomorrow. I also asked about any 5080's and he said "Yeah, if you're willing to spend $1500" I laughed and said hell no, I'll stick with what I've got. I also asked about the 9700 xt's, he said he hasn't gotten any new cards since launch day for the Radeon cards.
TLDR; I am incredibly lucky and fortunate that the folks at Micro Center were able to help me so quickly in a world where these GPUs are in such short supply. I completed the exchange and got a brand new 5070ti and the problem was resolved within a day and a half. I genuinely do not understand it all, but I am a happy customer. If I have the same issue with this new 5070ti I'll post it here. At the end of the day, I can say that it pays to live near a Micro Center.
