Question cant get pcie 3 to work on new nvme ssd

I recently bought a new nvme ssd. before i bought it, i went to make sure that its compatible. the ssd is pcie 4 but it says its backward compatible on pcie 3 motherboards. I put it in and installed windows on it. I installed crystaldiskinfo and it said the m.2 was using pcie 2, as shown in the image below. I went into my BIOS, set the pcie gen to 3, restarted my pc and its still stuck on pcie 2. Please if anyone can, respond asap.
my motherboard: GIGABYTE Z97-D3H-C
Could it be that i need my drive to be UEFI? or is that not relevant?

did you get a pcie m.2 card?
the m.2 slot on the motherboard only support pcie 2.0

My bet is that it's connected to a PCIe 2.0 slot. Some boards only support PCIe 3.0 on certain slots, like the one intended for the video card.
