CPU consuming more power than the mentioned TDP

I have i5 760 processor and I just noticed that my CPU is sucking more power than it should. The following page says that the max TDP is 95W - http://ark.intel.com/products/48496/Intel-Core-i5-760-Processor-8M-Cache-2_80-GHz

But as HWMonitor shows, power consumption goes up to 108.97W. When the processor is at 100% load, for most of the time it keep changing between fixed values of 95W and 108.33W in HWmonitor every few seconds.

Is this a serious problem? Is it causing the CPU to overheat?

its normal, don;t worry
Keep in mind that TDP=Thermal Design power, not electrical power consumption. Electrical power consumption will naturally be a little higher. Some stress tests like Intel's burn test can make chips dissipate much more than the TDP also
