Damaged gigabyte g1 gtx 970?

I ordered a new Gigabyte G1 Gaming Geforce GTX 970 from newegg. The card came in a antistatic bag with tape over it. It doesn't look tampered with but i thought instead of tape they came with a round gigabyte sticker. While inspecting the card i noticed a fin was bent close to the display ports. It even looks like one of the teeth are missing toward the right hand corner. The box also has some scrapes on it.

I'm looking for advise to hear thoughts if it's damaged or even refurbished. The fin isnt a big deal i can bend it back but if that section to the right is missing it's going back.

Newegg won't ship another card until they receive this one first. After, a new card will be shipped but it would be coming from the same vendor! I already waited over two weeks to get this card. If it is damaged, i'll take the refund and order the same card from somewhere else or get a different type of card. Is the gtx 980 worth the upgrade? If so, what manufactor? I will be adding a gpu block for cooling. Fingers crossed the card is fine =[ i just wanna game...

You can return it if you like, but that looks like shipping damage to me. Although, you could return it. I would, as it could of had been overclocked to hell or damaged before you got it
