Question Do I need to RMA my 2080ti?

So I have an issue with my GPU fans ramping up to 3400RPM when the card hits 73°C.
Setting a custom fan curve or having a constant fan speed in Afterburner works fine until card gets to 73°C, then all the setting go out the window and the GPU sounds like it's about to take off to mars.. I went into details in THIS thread and after more testing, I wanted to be 100% sure there was nothing hidden in my system that was controlling the fans like a crypto miner/virus or a hidden fan control so I installed a fresh Windows without any bloat and no apps other than HWmonitor, MSI afterburner and FurMark and to no surprise, the results were the same. HERE you can see a gif of how I’m running a furmark stress test in the background and the fans stay at what I requested with the afterburner until the temps hit 73C after that RPM goes to 3400+. I don't know what else can I do as it would seem the card will run the fans this way no matter what I do. Is this a reason for me to contact ASUS and RMA the card?
 
I would contact them first to get support, it's possible you may just need to flash the VBIOS to the latest version if it does not already have it installed (VBIOS is the bios firmware that runs the card like the BIOS runs the firmware of the motherboard). If they also can't help you solve the issue then I would suggest an RMA to them.
