Faulty GPU - advice needed on replacement

My GPU, a GTX 780 has been established as being faulty. When it comes to a replacement, should I be within my rights to ask for a GTX 970 as the replacement as it is of equal or lesser value than the 780 was at the time of purchase? I believe that the GTX 970 even today sells for slightly less than the 780. Am I correct on that?
 
The 780 does sell for higher then the 970 currently but I don't think they would give you a 970 unless the 780 was out of stock or DCed. Asking wouldn't hurt and even if they only wanted to give you a 780 its still a great card. Another option is to see if theres some kind of step-up program that would allow you to pay a bit more and get a 980.
 
Looking at their website, they don't seem to sell the 780 any more. Plus they include the 970 as standard in prebuilt machines that cost a lot less then mine did.
 


Yea but I wouldn't give up a 500$+ GPU (especially if its the 6gb version) for one that is around 350$ (give or take per manufacturer). I'd rather pay like 50-100$ and just get the 980.
