FX6300 Stuck at 3ghz

So like the title suggests my fx6300 seems to never reach a speed higher than 3ghz. when i force it manually to go to 3.5ghz using amd overdrive the temperatures reach into thermal throttling territory in about 55seconds. This is a pre built system and I'm planning to put on a 212evo either today or tomorrow to try and overclock it to 4ghz. but any ideas what could be going on?

MB = M5A78L-M/USB3
Ram 2x4gb 1600mhz
 
If you recently upgraded from another cpu to the fx 6300 and haven't recieved a new cooler I would buy one now or very soon in order to use the cpu at its fullest capacity since it sounds like you said the cpu thermal throttles even without an overclock. The cpu does this to keep itself from reaching TJ Max which the temperature the cpu starts to die/damage at.
 
i just installed the evo 212 i got from my ex about 2years ago .... and holly shit thermal margin stays around 40degrees ... when normally it would be reaching into less than 5. But the processor is still only going to 3000mhz and the target voltage is at 1.30 but it stays at 1.2125v
 
i have just updated the bios to the newest one the problem is still there. the clocks seem to sit at 4.2ghz when idling but as soon as i throw prime95 on it jumps between 4.2ghz and 3ghz randomly on each core for pretty much no reason i can see
