Overheating problems Be Quiet Dark Rock Advanced

A few days ago I bought Be Quiet Dark Rock Advanced cooler and replace the intel stock cooler with it. The problem is that the CPU temperature is higher than it was with the stock one. After that I install one case fan behind the Be Quiet and now the temperature is 37-44C when the CPU usage is 0%. Is it better to get the new CPU coller or to install more case fans.
My CPU is Intel i7 3770
 
I checked it 4 times, even put the better thermal paste and tried to change the position of the cooler. It's not my first time to mount something in the pc can't believe that the stock cooler and far more expensive cooler doesn't make any difference
