Free clue: You can't copyright an idea. You copyright
expression. In CoH you can create characters that manifest the
same expression as a Marvel comic book character.

Read the EULA from Cryptic. Cryptic will claim ownership of
anything you create in the game. It only takes ONE player to make
Wolverine given the different customes possible and Cryptic now
is claiming ownership of a Wolverine clone which it can put in
its monthly comic book.

Not good.

In America if something which can be used to infringe on copyright has a
legitimate use it's legal.

Again, this is irrelevant to the lawsuit with Marvel. First of all, just
because Cryptic claims something in a EULA doesn't make it law. Secondly,
if Cryptic took someone's Wolverine clone from their game made and
published it in their comic book, then AT THAT TIME they *might* be in
violation of Marvel's IP, for publishing the comic book, NOT FOR THEIR
CHARACTER GENERATOR! And "wolverine clone" would of course have to be
defined by the court, and not just "superhero with claws".

I'd love to see the section of USC you got that from. And even if it did
exist it still doesn't (or wouldn't) preclude the copyright holder from
suing.

By the time (the Leaning Tower of Pisa) was 10% built, everyone knew it
would be a total disaster. But the investment was so big they felt
compelled to go on. Since its completion, it cost a fortune to maintain and
is still in danger of collapsing. There are no plans to replace it, since
it was never needed in the first place. I expect every installation has its
own pet software which is analogous to the above.

He's probably refering to the 1984 Supreme Court case Sony vs. Universal
where the court ruled that the makers of the Betamax (and by association,
the VCR), which had a legitimate purpose other than pirating movies, were
not responsible for illegal uses of that tool.

I mean, it's common sense. We don't go after gun makers because you can use
them to murder people.

Before the House passed the ban on lawsuits against gunmakers there were
several cases brought against gunmakers. Bushmaster even paid out for the
DC sniper case:
