UPDATE: .. Received an email from the Online Retailer .. this is what he had to say about "ES" CPU's .. LOL

What Intel states are engineering samples are merely CPUs that are shipped to OEMs (Dell, HP, Gateway, etc.) for installation into computers sold by them. "ES" CPUs have more capabilities than their retail counterparts; even Intel states so. If the CPU was not what you ordered, there would be no way you could even boot Windows, let alone have a stable system.
We may differ on how ES CPUs are classified, but, regardless, we understand this will not satisfy you. We can submit on your account a full refund.

My little response back to them about the above email:
You didn't pull up the site did you (I sent him a link directly to Intel's website about the ES processors) .. in nice BOLD lettering " These processors are not packaged or labeled for sale to consumers... " .. I don't care what DELL, HP or Gateway does either .. that is not you .. you list on your website a Core 2 Extreme X6800 OEM processor .. that is NOT what you sent me.
Credit my account the FULL amount .. I'll deal with Intel Corporation directly about this.

So .. as you can see !!! This guy is clueless. I requested a FULL refund .. in which they responded honoring the refund and should show on my account within 3 days.
