windows 8.1 is unable to step up the cpu.

the problem is if i have windows 8.1 installed the cpu can not go above 400mhz. full stop. it just wont clock up. opening cpu demanding apps causes the system to slow to a stall and load things frame by frame. how ever windows 7 does not have any issues i have intel speed step turned off in the bios and am unsure of what the problem is
 
some more info

running a samsung 840 pro and a western digital velociraptor as a second drive
intel core i5-4460
8gb ddr3 1600 duel channel (2x4gb sticks).
gtx 750 in use at the moment just rma'd my gtx 770 with a cooler issue.
issue will always happen unless the cpu is set in the bios to the max multiplier and that causes the cpu to thermal throttle.
mobo is an asrock H81M-DGS R2.0.
