Windows 8.1 "upgrade" to Windows 8 Pro?

I have a new laptop I bought that has Windows 8.1 OEM installed. I have a product key to upgrade Windows 8 to Windows 8 Pro I also purchased (legit/valid key) a while back, in anticipation of needing to upgrade the windows version so I can use it at work.

I haven't been able to "upgrade" from Windows 8.1 to Windows 8 Pro (and perhaps eventually to Windows 8.1 Pro) because that is, apparently, non-compatible or an incorrect upgrade path despite the computer acknowledging that I have a legitimate key.

Is there a way I can get to pro from where I am without buying a whole new key? To me, the fact that 8 to 8.1 was a free upgrade means this should work, but any help appreciated. I really value the Tom's community for stuff like this.

I tried to use the code I had; but the computer (after verifying the code was legit) stopped half way through the upgrade and error halted.

Yes, that's what the Microsoft sales person was saying--but I figured if there was a group who knew of a workaround it might be here at Tom's. I guess it is just frustrating to have a legit product, and not be able to use it.
