Rma advice

Hey,
I recently purchased a 470gtx off eBay. I know, I know but they don't make the card anymore so not many options. The seller had sent the card to ASUS to be inspected and it came back with a sheet of clean health. When I received the card it did not work blue screen every time I tried to enable sli or every time I booted the card alone. So I RMAed the card, ASUS gets it says it's fine and mails it back. The card still doesn't work. So I flashed the BIOS to that of my evga 470gtx they are both reference pcb so I really didn't see the harm. Now everything seems to be working fine. The question is I had already contacted ASUS again so I can send them the card back or is there a way to check the stability of this card with my new BIOS and deem it fixed?
 


Since ASUS will mail me a different card the moment this one is in the mail...I'm not really worried. And yes I can flash it back in two seconds.
 
Personally after running OCCT for 2 hours with no errors I am ready to call it stable. This thing has already been sent to ASUS twice for them to deem it is perfectly fine. I really don't feel like getting jacked around again when it's obviously a bios incompatible issue.
